I just had a good trip to Washington (Divorce attorney) and later to San Diego and wanted to report on some interesting criminal defense related news: An article was posted today, December 17, 2009, on CBS Atlanta’s online news website. Chief Superior Court Judge Doris Downs held a news conference to make her feelings known about big cuts from the criminal justice system. She held the news conference after the Fulton County Board of Commissioners stated their approval last Wednesday of a tentative 2010 budget, which includes wide-ranging cuts. In criminal news out of Washington state, a story appeared in the Seattle Times Local News today, December 8, 2009, written by Steve Miletech, a Seattle Times Staff Reporter, titled: Clemmons’ sister helped alleged driver ‘lay low,’ court papers say. According to the Times, on Friday afternoon, during the arraignment of two women who are alleged to have helped Maurice Clemmons following the shooting of four Lakewood, Washington Police officers, LaTanya Clemmons, age 34, was taken into custody. Police booked LaTanya Clemmons into jail Friday evening. LaTanya Clemmons, also allegedly planned to buy a bus ticket to Arkansas for Darcus D. Allen, 38. Allen was arrested at a Federal Way motel last week and booked into the Pierce County Jail. He is under investigation to determine his role in the killings. I just returned from Washington by auto and there was no accident luckily, writing time over here., Several news outlets reported on December 1, 2009, that three people were taken to St. Mary’s Hospital in Grand Junction, Colorado after taking a fall at an abandoned electrical power plant. The Montrose police report that the three injured, aged 19 to 26, trespassed onto private property. All in all, the three people climbed a catwalk and fell. Two fell several stories onto pavement. The third was caught in mid-air, dangling by a strap on his backpack. Joshua Drown of Delta, Colorado, age 21, came loose and fell further before authorities could assist him. Someone needs a good lawyer, that is for sure.
The three face charges including unlawful consumption of alcohol and unlawful entry. Luckily for them no drunk auto driving or dui charge. Stephanie Pickett, 19 years old, was airlifted to a Denver hospital. She sustained multiple fractures. She will be charged with underage possession of alcohol and unlawful entry. The piece argues that the lower courts used Richmond Newspapers as a guideline to establish that right to civil proceedings.
The Supreme Court has repeatedly affirmed the public’s First Amendment right to access trials for more than 25 years, the Hearald contends. The Herald believes that the principle of transparency should be applied to civil cases. November 15, 2009, National Public Radio printed an article based on its Weekend Edition Sunday broadcast, titled; Hawaii Is Diverse, But Far From A Racial Paradise. I lived in Hawaii for a few years, on the island of Kauai. My experience matches the point of the piece. The point is that beneath the surface that is presented to tourists of a friendly, welcoming culture of diversity–characterized by its “Aloha Spirit,” — beneath that surface there exists old and widespread resentments between whites and native Hawaiians.
When I moved to Kauai in 1982 I felt the resentment when I began to look for a job. There was nothing overt, I just knew that the “locals” preferred to work with their own kind. I imagined how it must seem to them; a hoale (their slang equivalent of gringo) moves on over from the mainland. Then he or she takes one of their precious-few jobs, runs up the price of their precious-few rentals, and then after a few years, the novelty of living on a small island–even if it is paradise real estate wears off, and they go back to the mainland. Transient are most of us who try out living there in places like Kauai and Oahu, and there are some Kauai Real Estate issues as well I suppose.
But of course, that is far from the whole story. NPR’s article says that professor of Hawaiian studies at the University of Hawaii at Manoa, John Osorio, explains to the broadcast’s host, Liane Hansen, ‘that the state’s history is a story of accommodation as waves of foreigners flowed through the islands’ but many of these never left.’
